    Hi All,

    So I’ve been a member for a while but never said much about myself, but decided it’s a good time to give a bit of background and see if anyone is interested in anything I can offer.

    Im a qualified practicing solicitor, and I specialise in Wills, Lasting Powers of Attorney (LPAs), Probate and Tax advice (Inheritance Tax and Capital Gains Tax only).

    If anyone is interested in any advice, or having any of the above work done, let me know and I would be happy to discuss and agree fees at a hugely discounted rate compared to your local solicitors. For example – Wills = £45. A small amount more than a DIY WH Smith’s Will, but done from start to finish by a qualified professional and someone you can speak to, to actually get the advice you need instead of just filling in a form that might not be correct!

    More than happy to discuss and answer general questions on here (about the above topics) and happy to arrange private communication if you wish to discuss your personal specific circumstances.

    Ps. I’ve tried to stress that it’s limited to the above topics as there is a general misconception that lawyers are lawyers but I’m afraid we each have our own specialised area and I can’t help with anything outside of this scope.

    Afraid not mate, only UK taxes, but I do have close contacts for really high net worth individuals/companies if you’re talking £25m plus, otherwise it’s not worth the costs of setting up the planning etc

    There is a potential for me to take up your offer. There is a big chance that there could be some issues with my nans will once it becomes public record as the executors won’t let me and my brother and sisters see it. I’ll ask again when the times comes but it does look likely that we will need to speak to a solicitor about it. If that’s ok?

    Yeah of course that’s fine mate, once the executors have applied for probate the will becomes public and there’s a free government website you can check for when it’s been issued (you can then order a copy of the probate and the will for about £11).

    From the date probate is issued there is then a 6 month window to challenge the will/claim against the estate so there is plenty of time to assess everything and decide what the family want to do.

    Thanks. Probate was applied for around may 1st.  How long until the will becomes public? Or is it asking how long a piece of string is?. The issue we have is we don’t trust the executors as multiple lies have already been told plus my nan was very ill and on heavy opioids when we believe the will was made also we live 300 miles away from where my nan lived so we are being told very little information. If and when I’ll give you a message on this thread and I’ll give you my information so we can chat privately.

    The Will becomes public as soon as the courts issue the grant of probate (give or take a day or so for uploading it etc).

    You can check here for free to see when it has been issued:

    https://probatesearch.service.gov.uk/#wills

    Typically probates were being issued in 3 weeks, however, the courts recently changed how they produce them and are currently taking upto 12 weeks but they are steadily reducing that delay/backlog.

    Hopefully it might be in by the end of June judging on current timescales and you can keep checking that website above every couple of days to establish when it has been issued.

    I have a question, if a person passes away and there will goes through Probate can someone (the HMRC) make a claim against it once the deadline has passed? (this happened a year after Probate) and the person I know has been told they personally have to pay it back because they were the executor of the will. Is this correct?

    The “deadline” is for an individual to claim against the estate (I.e someone who feels they should have inherited but didn’t).

    inheritance tax is different. The executors are suppose to deal with HMRC and ensure all inheritance tax is paid. At the end of this process HMRC issue what is called a “clearance certificate” and the executors then know it is safe to distribute.

    in the case you described i suspect the executors distributed the estate to the beneficiaries and later HMRC raised enquiries and demanded tax. In this case yes the executors are personally liable as they should have obtained clearance before paying out the estate.

    it wasn’t tax they were after apparently it was a over payment of Pension Credits as the total amount that was left wasn’t enough to warrant any tax on it

    Can I get your email? The will still hasn’t become public record. I’ve looked online to find out if a will must go through probate and what I found is giving me some cause for concern. From my understanding there is a way for a will to not go through probate which then means it doesn’t have to become public record. Am I correct on this? Using the government website people who have died after my nan have had their wills become public record so im seriously worried that the executors have lied about the will going through probate. We have zero trust in them as they were only my nans neighbours and they are both husband and wife and have said they are beneficiary’s aswell. In addition they have  lied about family jewellery and given rings worth tens of thousands away to their own family already so need some advice on what I should do next, considering I have no information at all.

    drop me an email when you get it mate, but generally speaking probate is needed where there are assets of a certain value to be dealt with, however, some assets can be dealt with without probate (i.e Santander would release up to £50,000 without probate, but Barclays only £25,000 and NS&I up to £10,000). Probate is always needed for properties and shares, so it depends what assets were in the Estate as to whether or not probate is required.
